1. Introduction

Welcome to the Prohelpingkz website. These Terms of Use govern your access and use of the prohelpingkz.online website (hereinafter - "Site"), as well as the services offered through the Site (hereinafter - "Services").

By using our Site or Services, you agree to comply with and be bound by these Terms of Use. If you do not agree with any provision of these Terms, please do not use our Site or Services.

We reserve the right to change these Terms of Use at any time. Changes take effect from the moment they are published on the Site. By continuing to use the Site after the publication of changes, you agree to the updated Terms.

2. Definitions

In these Terms of Use, the following terms have the following meanings:

"Prohelpingkz", "we", "us", "our" refers to the Prohelpingkz entrepreneurship school, registered in accordance with the legislation of the Republic of Kazakhstan.
"User", "you", "your" refers to the individual who visits the Site and/or uses the Services.
"Site" means the website prohelpingkz.online.
"Services" means educational programs, courses, consultations and other services offered by Prohelpingkz through the Site.
"Content" means any information, texts, images, video, audio, data or other materials that are displayed, provided or accessible through the Site.

3. Registration and Accounts

To access some functions of the Site and use certain Services you may need to create an account. When registering, you agree to provide accurate, current and complete information about yourself and keep this information up to date.

You are responsible for maintaining the confidentiality of your credentials information, including the password, and for all actions that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other security violation.

We reserve the right to disable any account if, in our opinion, you have violated any provision of these Terms of Use.

4. Service Terms

4.1. Educational Services

Prohelpingkz offers various educational programs and courses on entrepreneurship. Detailed information about the content, duration and cost of each program is provided on the Site or upon request.

Registration for a program or course is considered an offer to enter into a contract for educational services. The contract is considered concluded after confirmation of registration from Prohelpingkz side and payment for services.

4.2. Payment

Payment for Services is made in accordance with the prices indicated on the Site at the time of registration. All prices are in tenge and include all applicable taxes unless otherwise stated.

We accept various payment methods, which are indicated on the Site. You agree to provide accurate and complete information about payment.

4.3. Refund Policy

If you decide to refuse educational services, you can request a refund in accordance with our refund policy:

Full refund (minus administrative costs of 10%) is provided if the request for cancellation is received at least 14 days before the start of the program or course.
Partial refund (50% of the paid amount) is provided if the cancellation request is received less than 14 days, but at least 7 days before the start of the program or course.
No refund is provided if the cancellation request is received less than 7 days before the start of the program or course, or after it has started.

In exceptional cases, we may consider the possibility of a refund or providing credit for future services at our discretion.

Refund requests must be sent in writing to the email address info@prohelpingkz.online.

4.4. Changes in the program

We strive to provide programs and courses as they are described on the Site, but we reserve the right to make changes to the content, schedule or format of the program if necessary. In case of material changes, we will notify registered participants as soon as possible.

5. Intellectual Property

5.1. Our Content

The Site and its contents, including, but not limited to, texts, graphics, logos, images, audio, video, software and other materials, are the property of Prohelpingkz or its licensors and are protected by copyright laws and other laws protecting intellectual property.

You may use the Site and its contents only for personal, non-commercial use and in accordance with these Terms of Use. Any other use, including, but not limited to, copying, distribution, transmission, display, reproduction or modification of any content of the Site without the prior written permission of Prohelpingkz is strictly prohibited.

5.2. Educational Materials

Educational materials provided within the framework of educational programs and courses, including, but not limited to, presentations, video lectures, workbooks, tasks and other materials, are the property of Prohelpingkz or its licensors and are intended only for personal use by registered participants.

You have no right to copy, distribute, publish, transfer or make available educational materials to third parties without prior written permission from Prohelpingkz.

6. Code of Conduct

When using the Site and Services, you agree:

To comply with all applicable laws and regulations;
Not to violate the rights of other users or third parties;
Not to publish or transmit any materials that are illegal, offensive, defamatory, discriminatory, threatening or otherwise unacceptable;
Not to attempt to gain unauthorized access to systems or networks connected to the Site;
Not to interfere with the operation of the Site or the servers and networks that provide the Services;
Not to collect or store personal data about other users without their consent;
Not to use automated means to access the Site or collect information from it;
Not to impersonate another person or organization.

We reserve the right, but not the obligation, to monitor and moderate content published by users, and delete any content that violates these Terms of Use or that we deem unacceptable for any reason.

7. Limitation of Liability

7.1. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis without any warranties, express or implied. Prohelpingkz does not guarantee that the Site will function without errors or interruptions, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components.

7.2. Limitation of Liability

To the maximum extent permitted by law, Prohelpingkz and its officers, employees, partners and agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including, but not limited to, loss of profits, data, use or other intangible losses arising from or in connection with:

Use or inability to use the Site or Services;
Any content obtained from the Site;
Unauthorized access, use or modification of your content or data transmission;
Statements or behavior of any third parties on the Site.

These limitations apply regardless of whether Prohelpingkz was warned of the possibility of such damages, and regardless of whether the claim is based on contract, tort (including negligence), strict liability or other grounds.

You agree to defend, indemnify and hold harmless Prohelpingkz and its officers, employees, partners and agents from any claims, liabilities, damages, losses and costs, including reasonable attorneys' fees, arising out of or in connection with:

The Site may contain links to third-party websites that are not owned or controlled by Prohelpingkz. We are not responsible for the content, privacy policies or practices of any third-party sites. We are not responsible for any damage or loss related to use or reliance on any content, goods or services available on or through such sites.

10. Termination

We may terminate or suspend your access to the Site and Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms of Use.

Upon termination, your right to use the Site and Services will immediately cease. If you wish to terminate your account, you can simply stop using the Site.

11. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan.

Any disputes arising from or in connection with these Terms of Use, including any questions regarding their existence, validity or termination, shall be subject to resolution in the competent courts of the Republic of Kazakhstan.

12. Changes to these Terms of Use

We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material, we will try to provide notice before the new terms take effect. Determining what is a material change will be made at our sole discretion.

By continuing to use the Site or Services after the changes take effect, you agree to the updated Terms of Use. If you do not agree with the new terms, please stop using the Site and Services.
